PointShop is a home page and a service, which offers its users to earn points by making use of announcers offer through PointShop. The accrued points may be subsequently used to ordering products from our suppliers in shoppen of PointShop.
These conditions explains how you must use PointShops service and home page (www.pointshop.dk ), and how we protect your personal information.

2. Terms and agreement
2.1 Accept of terms and agreement
When you register as a user/member of PointShop, you confirm that you have read the terms of service and that you accept them as an agreement between you and PointShop; whereupon you and PointShop are committed to the conditions of the terms.
With your registration you agree that PointShop may mail you electronic newsletter on the e-mail address you register with.
Important updates, conversion and changes in the terms are publish on the front page of the PointShop website.
The terms has the version number 20110826 and is valid from August 26th 2011.
2.2 Rights
All rights to the koncept Pointshop, and the website www.pointshop.dk, its service, koncept, design, content and splitelements hereunder, but not limited to tekst, grafiks, fotografies, sound- and fotoshoots, software and URLs, belongs to Pointshop and/or the announcer and/or the supplier and cant without Pointshops and/or the announcer and/or the supplier konkrete prior consent be copied, shown or distributed to thirdman, here under at normal linking and at deep linking. Abuse without such a permission from the koncept Pointshop, websitet www.pointshop.dk and its content represents an violation of the copyright law, including this law`s rules about databaseprotection, as like there can be talk about other violations of other inmateriallegal law`s and marketinglaw.
3. Subscription as user (member)
3.1 Special note for children under the age of 15 years
You have to be at least 15 years old to sign up at PointShop. Do not sign up, if you are under 15 years of age.
3.1 A special note to parents who has children under the age of 15 years
Allthough we forbid registrations from children under 15 years, you as a parent should monitor your childrens online activities and consider your options for a safer use of the internet by using controlling programs from onlineservices and softwareproviders. These programs help by creating a childfriendly environment on the internet.
These tools can also prevent children from giving out their nam, adress and other personal information without permission from the parents.

3.3 Information about personal informations and password
In order to use PointShop you must inform us about your identity; you must be a private individual above the age of 15 years; you cannot have been declared incapable of managing your own affairs; and you must be reside in the UK. We do not mail products to PO boxes or poste restante. Enterprises and other legal persons cannot register.
You are obligated to update your information at PointShop at soon as the changes occur.
3.4 E-mail address and personal password
When you sign up for PointShop, you must register with an e-mail address and an optional access code.
The accesscode is a very personal information, which you are obliged to keep for yourself and therefore it must not be transfered to others. It gives you the guarantee that it is only you, who can access your account at www.pointshop.dk. Orders from your account in PointShop-shoppen by use of your access code, unless there is abuse, see below and point 8.2 about responsibility and barring by abuse.
If you have a suspicion that some have had access to your access code, you must immediately notify the PointShop's support. If you don't, you are responsible for a possible abuse. You will shortly receive a confirmation from support to the fact that we have blocked your account with an indication of the time of your communication.
PointShop is not responsible for losses as a result of, a third part receives access to the account, or a publication of password to a third part.
You have to be registered user of the e-mail address, you use. This means that your e-mail account must be personal and it must be linked to an e-mail account with password. Your e-mails must not be available to others. Your e-mail account must also not automatically delete your e-mails.
3.5 Account (member account)
We only allow for one membership per person. It is not allowed to hold multiple memberships. It is with that not allowed to hold one membership on your home address and another on your work address, educational instition or anything resembling that.It is not allowed to enter with someone else's e-mail address, name or other personal data. It is also not allowed to effectuate offers or buys with another persons e-mail address, name or personal data.Anyone holding multiple memberships (regardless of it is by same IP- or e-mail address) can have all their memberships cancelled and loose all earned points.Any user having their membership cancelled will be exempt from entering another membership at PointShop.
3.6 Newsletters
As a subscriber to PointShop you will receive electronical newsletters from PointShop via e-mail, which informs you about news and offers.
If you wish to be informed via e-mail about new campaigns, you can earn points by at PointShop, you can subscribe to this extraordinary newsletter via www.pointshop.co.uk/setup.asp. If you wish to unsubscribe this extraordinary newsletter, you can do it the same place.

PointShop are not responsible, if a newsletter or other communication does not get to the member, or if a members e-mail or other communication does not reach PointShop, for example if e-mails get cought in SPAM filters.
3.7 Closing of account
If you wish to close your account, you can easy, fast and free at any time do so via www.pointshop.dk/helpdesk/guide_deleteprofile.asp

3.8 Unauthorized access
Any attempt at unauthorized access (eg hacking) to the website is illegal and will be prosecuted.
3.9 Rules for use of credit card upon payment of VIP membership
It is not allowed to sign up for PointShop's paid services (VIP membership) with another persons credit card. In the case of PointShop find out, that a member with an active or unsubscribed VIP membership, also have signed up/paid for other persons with the same credit card, PointShop reserve the right to unsubscribe the VIP membership in question, refund the amount paid, and cancel earned or awarded points to the account in questions. This also counts for points awarded the owner of the credit card or the account owner, as of have reffered VIP members to PointShop for the purpose of earning points.
If there at the same time has been send introduction gifts, either by mail or e-mail, these then have to be returned unopened and unused to the supplier within 7 days of notification. In case of other PointShop will send the member, who is responsible for the abuse/or the activety, an invoice for the costs, which PointShop have had in connection with the abuse.
4. Earning of points through offers
4.1 Completion of offers
You can earn points by accomplishing offers shown at www.pointshop.dk. You will only earn points if you sign up by clicking on the offers at www.pointshop.dk and fill the subsequent registration with the correct personal data. The correct personal data are the same that you are enrolled in at PointShop. You will not earn points by signing up via other banner ads, web sites etc. You will only earn points from offers, that you have not completed in the past by other banner ads, web sites etc. You are bound to only use correct data in the process of completing offers. If we determine that you have earned points by an erratic manner (either by making orders with fake or untrue data, or by exploiting technical weaknesses in the PointShop system), your account will be closed without further warning. In that case you will be deleted as user of PointShop, and you will lose any points earned. To earn points you must be sure that your web browser are set to accept all cookies, so that PointShop can register the process correctly. To earn points you will also have to meet the conditions of the completion of the offer. You must try out the product due to the offer before it can be terminated. You are responsible for saving the automatically generated verification email, that you will receive when you have completed an offer. If the automatic update of points fail, PointShop are reserves the right to refuse to register points, if you can not present a valid verification email as proof of your completion of the offer, which the point registering concerns.
4.2 Update of points
You can only earn points at PointShop, if the following terms apply:
- That there only are one account per person
- That the personal information (such as e-mail, name, address) on the account is correct at all time
- That the offer has not been used before - neither through other channels as for example banneradds, websites, etc.
- That all the terms for completion of the offers are met
- That there are not systemerror or -breackdown in PointShops computer system or 3 parti computer system with the result, that points are not registred, unless e-mail confirmation can be documented
If you think that you have completed an offer and your point aren't updated within 48 hours, please check that you have lived ud to the demands in the offer. In case that you think you have met the demands, please send your confirmation mail concerning the offer to Support, who will look through the case after this.
4.3 Terms of the offers
It is the priority of PointShop that both users, offerors and suppliers have a good experience at www.pointshop.dk, for which reason we are careful in selecting our offerors and suppliers.
You should therefore always thoroughly read though which terms, conditions and potential costs apply to the deal with the offeror (advertiser). In case of problems with the advertisers offer, service or product, you are asked to contact the advertiser directly.
PointShop is in no way responsible for the agreements a user enters into with an advertiser, and all offers are completed at the users own risk.
5. Purchase with earned points
Points are the value used in www.pointshop.dk. You earn points by using our tenderers (advertisers) bids. It is not possible to get your points paid, transferred to another account, or turned into money.
Point declaration contains 25% VAT.
5.2 Purchase of products in the shop at PointShop
The earned points can only be exchanged into products from the shop from our suppliers. By every product it is written, how many points you have to have earned to be able to order the poructs.
You cannot exchange the earned points into procuts or services at our advertisers (offer holders).
With reservations for typos-, gramatical- and pointpricing erros. In case that you should have ordered a procuts, which has stated a incorrect amount of points, we reserve the right to cancel the order (in case of this you will receive the points back).
To be able to order products in the shop at PointShop you have to activate guarantee of your e-mail address, dit mobile phone numner and your postal address via www.pointshop.co.uk/myaccount.asp first. The reason for this is, that we want to ensure PointShop, suppliers, advertisers and you agains fraud and abuse.
If we subsequently discover that a member has received a product by cheating, PointShop will demand rightly claims against the member, this is the product's value and an administration fee of 70 pounds inclusive VAT.
5.3 Delivery of products
PointShop does not have a stock itself. We cooperate with shops and webshops (suppliers), which is in charge of delivery of products ordered in the shop at PointShop.
All P&P costs for products ordered in the shop at PointShop is paid. We strive, that out suppliers has as short dilevery time as possible. The delivery time can vary and be delayed, if a products is our of stock or caused by holiday/vacations.
Products will be delivered to the address, which you have stated on your account. If you order a product in our shop, which returs to our supplier because of incorrect address or like, which you are responsible for, the points will returned to your account, though we reserve the right to demand a handling fee in points, which calculated is equal to the cost, there have been for P&P.
If the package has been lost in the mail, you have to use the tracking code the supplier has send you via e-mail or told you on phone.
If there are no tracking code for the package, you should as soon as possible look for it and within 2 months.
It is possible, that a product is now more avaliable at a supplier. If this happens, we will refund your points to your account.
5.4 Delivery
It can be, that there are delivery problems for a product, or a product no longer is avaliable from a supplier. If this happens, you can get your points back on your account.
The supplier of the product sends you your free product within cirka 2-8 weeks. The delivery time can vary depending of product and supplier. Most products will be delivered within 2-6 weeks, meant from the time where your through PointShop orders the product. PointShop reserve the right to refund the points, so you instead can use them on another product. In case of delay of product delivery to the member, PointShop does not refund for possible delay.
If you within 20 work days have not received your order and has confirmed for PointShop, that your address is correct, you can contact the supplier via www.pointshop.co.uk/helpdesk/showorder.asp, after this the supplier will look for the product, and if the supplier finds it nessecary, send a replacement product or refund the points.
If you do not object against PointShop non-delivery of ordered product within 3 months after the product was ordered and approved in the shop, then your right of complaint is droped, since PointShop after 3 months, no longer are able to obtain shipping data from our logistics partners
5.5 Returning of product
In case you received another product than the one you ordered you should as soon as possible notify the supplier or PointShop who then will make a fair attempt at delivering the right product. All this is provided that you have made your notification in fair time and that the received product is returned.If a product is defective you should only notify PointShop who then will take care of handling your potential claim.
5.6 Right of withdrawal
5.6.1 PointShops suppliers
According to the rules of withdrawal in the danish Consumerlaw about remote sale you have a right of withdrawl on the products, which you order through the shop at PointShop. The right of withdrawl applies for 14 days from the time, where you receive the product. Use of the right of withdrawl can be done by returning the product to the suppliers address or by refusing recipient of the product.
The costs for returning the product is yours. The returned product have to be a the same state as when delivered. In case of the terms of withdrawl is ophold, we will within 30 days after returning of the product, refund the amount of points, which the product was acquired for, on your account.
The right of withdrawl does not comply for products, which has been used, if it is obviues, that use has caused a decrease in value of the product, and by sealed sound- or phototakes or computer programs, if your breached the seal.
5.6.2 PointShops advertisers
For products, that you buy directly by completing an offer from one of our tenderer (advertisers) on pointshop.co.uk/, applies to the rules, which appears in the tenderer's offer. The right of cancellation should in that case be valid for the tenderer in agreement with the indicated rules, and PointShop has no responsibility for this.
6. Personal data
6.1 Treatment of personal data
We treat all personal information according to danish law.The data we collect and the data you give us is encrypted and stored on servers protected by passwords and firewalls. Your data is thus only awailable to you and trusted employees at PointShop.PointShop will not under any circumstances impart this data without your consent. Exempt from this is legislation demands or solicitations from police or justice departement.
6.2 Automatical collection of personal data
A condition for earning points at www.pointshop.dk is that your browser will accept cookies. A cookie is a small data file containing information a website will store permanently on your harddrive. There are also cookies that temporarily attach themselves to your computer when you visit the website. They will dissapear once you leave the website. The cookie enables the homepage to recognize your computer and improve user friendlyness. Cookies are used by all larger websites.Our cookies will not reveal any identifiable or personal data but will allow us to collect, register and handle the parts of our website that interests you and how long you are logget on. That way we can adjust the website according to your needs. We can also see which websites our visitors are coming from.You can delete these cookies at any time. If you set your browser to automaticly delete cookies that might lead to campaign malfunctions and you not receiving your points. Your IP-address is also registered for statistical purposes and to better our advertising and layout on the website.
6.3 Third parti personal data policy
PointShop only gather your personal data with your clear approval.
6.3.1 Advertiser, supplier and other companies
PointShop's web site contains links to other web sites - typically advertisers. PointShop has no control of the content published at third-party web sites and can not be holded responsible for the terms of use, privacy politics or the personal data, that these web sites gather automatically. Your use of these web sites makes you subject to the current third-party terms and conditions including rules of personal data. We urge you to read their conditions and privacy statement carefully.
6.3.2 Speciel cases
We may confidentially share parts of our statistical data about your use of our content. These data may include demographical data such as age groups and/or geographical locations of certain user groups. It will not be possible to identify personal data such as name or e-mail addresses from these statistics.
When you use PointShop, your behaviour may, in a purified manner, be used for a larger study or analysis, e.g. about the visitors' purchase behaviours. Information of your specific purchase will not be used separately in proportion to you. The above mentioned studies are completed by ourself and our affiliates, who as well are subject to confidentiality.
We do not sell or share your personal data with other parties of our concern without your expressed consent. We do though reserve our right to sell or share all data, including the personal data, to a third party in case of sale, fusion, merger, control changes, transfers of significant actives, reorganisation or liquidation of our concern - including PointShop. All actions will naturally be completed in compliance with the Danish Law of Personal Data.

8. Responsebilety
8.1 Limitation of responsebilety
PointShop does not take responsibility for more than what PointShop is required to by the Danish law.
PointShop is not in any way responsible for any circumstances, that are not directly controlled by PointShop (force majeure), such as but not limited to: strike, lockout, fire, lack of transportation, war, exchange controls, computer virus, hacking, system failures and dropouts, restrictions and bans of import/export, power failure etc.
8.2 Responsebilety and blocking by abuse
You can be held responsible due to other peoples unrightful use of your pass word connected with your account according to the regulations and limitations due to the law of payment means § 11.
PointShop puts your account on hold under the following circumstances; when you tell Support that you have suspicion of unrightful abuse of your pass word; jf article 3.4, or if PointShop have reason to believe that your account is being used abuseful. Your account will be reopened as soon as it is made sure that absuseness is out of the question as you at the same time will be getting a new pass word.
8.3 General netetiquette
We reserve the right to delete a profile, in case of the general netetiquette is not beeing held. Good netetiquette is godd behaviour and a respectable tone, where you show respect for PointShop and other people.
9. Delinquency of terms
PointShop reserve the right to delete your account without warning, if you break the terms. If your account is deleted caused by break of terms, are PointShop justified to close your account, by which you lost the points, which you have earned.
Of course PointShop wants a good relationshop to all of our members, and our support will in case of abuse generally, delete your account and contact you, with the reason in mind. You can always contact the support, if you think your deletion are unjustfull. You should in all cases where you are in doubt about rules and terms, contact our support, so you can get guidance in and explenation of propper use of PointShop.
